1. Acceptance

These Terms of Service ("Terms") govern your access to and use of the VOL Handyman platform (the "Platform"), operated by VOL Handyman ("we", "us"). By creating an account, posting a job, accepting work, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. The Platform is a venue

VOL Handyman is a marketplace that connects Clients with independent service providers ("Pros" and "Students"). We are not the employer of any Pro or Student, and we do not perform the services ourselves. Each Pro and Student is an independent contractor responsible for the quality, safety, and timeliness of their work.

3. Eligibility

Clients and Pros must be at least 18 years old.
Students must be at least 16 years old. Students under 18 confirm that a parent or guardian has reviewed these Terms with them.
You must provide accurate information and keep it current.

4. Accounts

You are responsible for all activity under your account and for keeping your password confidential. Notify us immediately if you suspect unauthorised access. We may suspend or terminate accounts for breach of these Terms, fraud, safety concerns, or repeated poor performance.

5. Bookings, payments, and commissions

Quoted prices are estimates; final pricing depends on actual work performed and any change orders agreed in writing.
All payments for jobs introduced through the Platform must be made through the Platform.
We retain a 15% commission on each job. Net amounts are remitted to Pros and Students per the published payout schedule.
Sales tax (HST) is applied where required.

6. Cancellations, no-shows, and refunds

Clients may cancel a confirmed booking up to 24 hours before the scheduled start at no charge. Cancellations within 24 hours may incur a fee of up to 50% of the quoted price.
If a Pro or Student does not arrive within 60 minutes of the scheduled start, the Client may cancel at no charge and request reassignment.
Refunds for completed work are handled on a case-by-case basis when the work materially fails to match what was booked. Contact us within 7 days.

7. Conduct

You agree not to:

Solicit Platform users to transact outside the Platform.
Harass, threaten, or discriminate against any user.
Post false, misleading, or defamatory content (including reviews).
Use the Platform for illegal activity or to violate any third party's rights.

8. Reviews and content

You retain ownership of content you submit (photos, reviews, messages) but grant us a non-exclusive, royalty-free, worldwide licence to host, display, and use it to operate and promote the Platform. We may remove content that violates these Terms.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted or error-free, nor do we warrant the quality, safety, or legality of services performed by Pros or Students.

10. Limitation of liability

To the maximum extent permitted by law, VOL Handyman's total liability arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount you paid to us in the 12 months preceding the claim, or (b) CAD $100. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Indemnity

You agree to indemnify and hold harmless VOL Handyman, its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or third party right.

12. Insurance

Pros are expected to carry general liability insurance and any trade-specific licensing required by law. Students performing light residential tasks are covered by the Platform's basic liability policy for jobs booked through the Platform, subject to policy terms and exclusions.

13. Termination

You may close your account at any time. We may suspend or terminate access for breach, fraud, safety risk, or business reasons. Sections that by their nature should survive termination (payments owed, liability limits, indemnity, governing law) will survive.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario have exclusive jurisdiction over any dispute, subject to mandatory consumer protection laws of your province of residence.

15. Changes

We may update these Terms from time to time. Material changes will be communicated by email or via the site. Continued use after the effective date constitutes acceptance of the updated Terms.
